Breeder's Guarantee and Purchaser's Obligations to Validate Guarantee:

 

The breeder swears that to the best of their knowledge, the above puppy/dog is free of any illness or disease.  The purchaser is responsible for taking the above puppy/dog to a licensed veterinarian within five days of receipt of puppy/dog for a medical examination.  If medical problems are found, IT IS THE PURCHASER'S RESPONSIBILITY TO PROVIDE THE BREEDER WITH VETERINARIAN REPORTS TO PROVE THAT THIS PROBLEM WAS PRESENT WHEN THE SAID ANIMAL WAS RELEASED FROM THE BREEDER’S CUSTODY.  The breeder has the option of reimbursing the purchaser for medical (Veterinarian) expenses, or providing the purchaser with a replacement puppy/dog of the same value.

 

The breeder will not be responsible for any illness or disease after five (5) days have passed, nor will they be responsible for any problems which may arise after the puppy/dog has been given a clean bill of health by the purchaser’s veterinarian.  The only exception to this is described the above paragraph.

 

The breeder will replace the above puppy/dog, if the purchaser provides the breeder with a veterinarian's certificate proving that the above puppy/dog suffers from FATAL CONGENITAL ILLNESS (heart, kidneys, etc.) and was present when the said animal was released from the breeder’s custody.

 

HIP GUARANTEE:  If, at any time from the date of purchase up to two years of age the above puppy develops moderate to severe clinical hip dysplasia (crippled, causing suffering and lameness) attested to by x-rays and evaluation by a competent, licensed veterinarian, due to congenital defects rather than neglect, injury or environmental circumstances, the puppy/dog may be returned to the breeder at the expense of the buyer, with appropriate documentation.  The breeder will then replace the puppy/dog as soon as a suitable replacement becomes available.  The breeder reserves the right to request that the x-rays be sent for review to a board-certified veterinary radiologist at the expense of the buyer.

 

This hip dysplasia guarantee expires: ___________________________.

If a puppy/dog has been purchased for the purpose of breeding/showing (and has earned a championship title) is found to have clinical hip dysplasia attested to by the OFA, the seller agrees to co-ownership of a replacement puppy/dog of equal value to the original puppy/dog purchased.

 

BUY-BACK GUARANTEE:  If the purchaser is unhappy with the puppy/dog within two weeks of purchase, the breeder may buy the animal back at a maximum amount of seventy-five percent of the original purchase price.  If after the two-week period, the purchaser is unhappy with the puppy/dog it is the breeder’s choice as to the amount, if any, that will be offered for the return of said animal.

 

It is further understood and agreed that no other warranty or representation has been made with respect to the sold puppy/dog, except as set forth in this agreement.
